Aggrieved by illegal plying of Totos, Magic Vans and Irish Vans without any valid route permit, the petitioner submitted an application before the Regional Transport Office, Behala being the 5th respondent herein on 16th December, 2022 which is still pending. The petitioner prays for a direction upon the authority to consider the application and take necessary steps in this regard at the earliest.

Learned counsel for the 6th respondent supports the contention of the petitioner.

Upon consideration of the submission made on behalf of the parties, the writ petition is disposed of directing the 5th respondent to consider and dispose of the application made by the petitioner dated 16th

December, 2022 within one month from the date of communication of this order upon affording reasonable opportunity of hearing to all the affected persons including the petitioner and the private respondent, in accordance with law.

The writ petition is thus disposed of.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
