1. Learned advocate appearing for the petitioners submits that this revisional application has been wrongly filed assailing the order dated January 08, 2026 passed by the learned Civil Judge, (Senior Division), 1st Court, At Barasat in T. S. Case No. 1102 of 2024. She submits that since the order impugned is one whereby an application for temporary injunction has been rejected, therefore, the same is appealable under Order 43 Rule 1 (r) of the Code of Civil Procedure, 1908. She seeks leave to withdraw the revisional application and to avail the appropriate remedy in accordance with law. The opposite parties are represented through Mr.

Ghosh, learned senior advocate.

2. As prayed for, CO 268 of 2026 is dismissed as withdrawn with liberty to the petitioner to approach the appropriate forum in accordance with law. The petitioner shall be entitled to take back the certified

copy of the order impugned upon furnishing a photostat copy thereof duly countersigned by the learned advocate on record for the petitioner. (Om Narayan Rai, J.)
