Mr. Jayanta Kr. Mondal ...For the respondent No.1/claimant Counsel for the appellant/Insurance Company submits that one application being CAN 2 of 2021 has been filed by the appellant/ Insurance Company for withdrawal of the instant appeal. He further submits that the Insurance Company does not wish to proceed with the instant appeal.
Considering the submissions of the appellant/ Insurance Company, the application is disposed of. Accordingly, the claimant is at liberty to withdraw the award amount of Rs.3,89,500/- along with accrued interest, if any, lying with the Registrar General of this Hon'ble Court within a period of four weeks from the date of communication of this order. The claimant/respondent No.1 shall furnish particulars of her bank account as also proof of identity with the Registrar General of this Hon'ble Court as expeditiously as possible. Upon deposit of such details, the Registrar General is directed to pay the aforesaid amount
deposited along with any accrued interest to the claimant/respondent no.1 in accordance with law as per award within a period of four weeks. The Registrar General shall check the veracity of the bank account and the identity of the claimant before disbursing the amount. With the aforesaid directions, the instant appeal is disposed of.
In view of disposal of this appeal, the connected application, if any, is also disposed of. The concerned department is directed to tag the applications, if any, with the main appeal.
LCR, if any, may be returned back to the Court below.
There shall be no further order as to costs.
Urgent photostat certified copy of this order, if applied for, be given to the parties, upon compliance of all formalities, on priority basis.
