NB 22.02.2022 CRR 300 of 2022 In the matter of:- Nepal Halder & Ors. ...petitioners Ct. No. 39 Mr. Kunal Ganguly, Mr. M. A. Elahi.

...for the petitioners.

Mr. Ranabir Roy Chowdhury, Mr. Mainak Gupta.

....for the State.

Mr. Jayanta Narayan Chatterjee, Mr. S. Naskar.

...for the OP No.2.

Learned Counsel appearing on behalf of the petitioners submits that there are some incurable defects in the revision petition inasmuch as no pleading is present regarding a proceeding under Section 138 of the Negotiable Instruments Act. Nor has any certified copy of the said proceeding been annexed with the revision petition. He submits that his client would not like to press this application and would instead file a fresh application on the self-same grounds.

On his prayer, the revisional application is disposed of as not pressed.

On the further prayer of the learned Advocate on record of the petitioners, the Office is directed to return the certified copies of the documents annexed with the revision petition to the learned Advocate on record of the petitioners on usual undertakings and on supplying a photostat copy of the same for the record.

Urgent photostat certified copy of this order may be supplied to the parties expeditiously, if applied for.
