Chatterjee, Advocate ......for the State The instant writ-petition is taken out under Article 226 of the Constitution at the behest of the petitioner seeking a direction upon the West Bengal Land Reforms and Tenancy Tribunal to dispose of the application for condonation of delay being MA 1023 of 2019. Our attention is drawn to the certified copy of the orders passed in the said application wherefrom it appears that the tribunal application was taken out way back in 2019 together with a application for condonation of delay which has not been disposed of as yet.

It is unexpected that the application for condonation of delay is kept pending for such a long time and the Tribunal is mechanically adjourning the matter citing an office order dated June 29, 2021. Unless the condonation is done the parties are precluded from making any interim prayer and, therefore, it may frustrate the very purpose of approaching the Tribunal. The last date was fixed on January 20, 2022 but we are informed

that even on that day citing the said officer order, the matter is mechanically adjourned.

We, therefore, direct the learned Judges manning the Third Bench of the West Bengal Land Reforms and Tenancy Tribunal to fix a date for disposal of the application for condonation of delay being MA 1023 of 2019 in presence of the parties which shall not exceed fifteen days from the date of communication of this order.

The Tribunal shall thereafter proceed to dispose of the said application on the date so fixed and in the event, the same cannot be disposed of, endeavour shall be shown to dispose of the same within a week thereafter.

With these observations, the writ-petition being WPLRT 12 of 2022 is disposed of.
