Affidavit-of-service filed in Court today is taken on record.

None appears on behalf of the respondents in spite of service.

The father of the petitioner was an employee of Basirhat Municipality. He died-in-harness on 19th September, 2016.

The mother of the petitioner applied for providing compassionate appointment in favour of the petitioner, being her son.

The petitioner also applied independently seeking employment after obtaining no objection from the other heirs of the deceased.

The said application was filed on 24th October, 2016 and the same is pending consideration till date.

As the matter relates to compassionate appointment, the application of the petitioner is required to be considered on urgent basis as the same involves the livelihood of the petitioner and his family members.

In view of the above, the writ petition is disposed of by directing the Basirhat Municipality to take a decision on the application made by the petitioner for grant of compassionate appointment in accordance with law, at the earliest, but positively within a period of six weeks from the date of communication of a copy of this order.

A reasoned order shall be passed and communicated to the petitioner clearly mentioning as to whether his application is being allowed or not. The learned advocate appearing for the petitioner is directed to forward a copy of the death certificate of the employee along with the application made for compassionate appointment to the Municipality at the time of communicating the order of the Court. The writ petition stands disposed of.

Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible.
