Affidavit-of-service is taken on record. Despite service, none appears on behalf of the respondent Nos.8 to 13, 15 and 16. The respondent No.14 has refused service. The Court is not inclined to pass mandatory directions as prayed for. The matter is sent back to the appropriate authority for appropriate steps. The writ petition is thus, taken up in the absence of the respondent Nos.8 to 16 who will be given adequate opportunity of hearing by the authority.
The writ petition is disposed of with a direction upon the competent authority of Talgachhari No.1 Gram Panchayat, Purba Medinipur to intimate the petitioner as to whether any permission had been granted for construction on Dag Nos.155, 156, 157, 158 and 166 of
mouza Bagpura, to any person. Such intimation shall reach the petitioner within a period of ten days from the date of communication of this order. A copy of such intimation shall be forwarded to the respondent Nos.8 to 16. The police report is taken on record. The contents thereof, are not relevant for the purpose of disposal of the writ petition.
This Court has not made any observations on the merits of the case.
This order shall not be construed as an observation of the Court on the right, title and interest of the petitioner in respect of the land in question.
The writ petition is, thus, disposed of.
There shall be no order as to costs.
Parties are to act on the basis of the server copy of this order.
