C.R.M.(NDPS) 136 of 2022 (Via Video Conference) (AD) 03.02.2022 Court No.29 In Re: - An application for bail under Section 439 of the Code of Criminal Procedure in connection with Berhampore P.S. Case No.695 of dated 26/06/2018 under Sections 20(b)(ii)(c)/29 of the Narcotic Drugs and Psychotropic Substances Act arising out of NDPS Case No.187/2018. And (Rejected) In the matter of: Asraf Ali @ Arsap ....petitioner.

Mr. Jisan Iqubal Hossain ...for the petitioner.

Mr. Saibal Bapuli, Ld. APP Mr. Bibaswan Bhattacharya ... for the State.

Petitioner seeks Bail.

Considering the fact that commercial quantity of narcotics was seized from the possession of the petitioner, we are of the view that the petitioner is unable to overcome the restrictions under Section 37 of the NDPS Act, 1985. Moreover, the trial commenced and, therefore, it is not advisable to enlarge the petitioner on bail at such crucial stage. Consequently, we are unable to grant bail to the petitioner.

Accordingly, the prayer for bail of the petitioner is rejected.

C.R.M.(NDPS) 136 of 2022 is dismissed.
