Learned advocate for the petitioner submits that the petitioner filed one application for transfer which ultimately reached to the School Service Commission but the Commission has returned it on the ground that 'prayer is returned due to the low rank in preferred school applied by the candidate'.

Learned advocate for the petitioner submits that she named three schools in the portal out of which only the posts of Balibhara Saraswati Bidyamandir have been filled up but the posts in other two schools as has been named in paragraph 5 of the writ application are

still vacant. The grievance of the petitioner is that she selected three schools. She could have been recommended for transfer to one of the two schools where there are vacancies. Learned advocate for the petitioner further submits that the vacancy position would be there in page 7 of the writ application. I direct the petitioner to send a representation immediately to the Secretary of the School Service Commission quoting paragraph 5 of the writ application with a copy of this order and the Secretary of the School Service Commission is directed to consider the matter within a period of seven days from the date of receipt of the representation with a copy of this order after giving an opportunity of hearing to the petitioner. If the Commission finds that the petitioner is otherwise eligible to get transfer, the Commission will take immediate steps for recommending the name of the petitioner in that school.

With the above direction, this writ application is disposed of.
