Mukherjee ...For the petitioner It is submitted on behalf of the petitioner that Title Suit 47 of 2016 was filed before the learned Civil Judge, Junior Division, 1st Court, Malda in the year 2016, and upon complying with all the formalities, the petitioner was examined as PW-1 on 17.09.2016, and after six adjournments, the cross-examination of the petitioner was completed on 12.04.2017. After closure of evidence of PW1, the Title Suit was adjourned for eight times for evidence of PW-2. It has been done only on 19.02.2018 and thereafter the cross-examination of PW-2 also closed on 04.06.2018. The suit has been adjourned since thereafter for one reason or the other at the instance of the defendants.

Learned counsel for the petitioner submits that a direction may be made for expeditious disposal of the suit.

In view of the above, the learned trial court is directed to make expeditious trial of the suit and to

dispose of the same preferably within a period of one year from the date of communication of the order without granting any unnecessary adjournment to either of the parties.

C.O 176 of 2019 is thus disposed of.
