The petitioner says that the dispute between the petitioner and the private respondent has been amicable settled and as such, there is no embargo on the petitioner in getting new connection as applied for.

Learned advocate appearing on behalf of the private respondent agrees to the settlement of the dispute.

On behalf of the CESC Limited it is submitted that subject to payment of the requisite costs and other statutory compliance, the petitioner will be provided with new connection.

In such facts and circumstances, the petitioner does not want to proceed any further with the writ petition.

The writ petition is dismissed for nonprosecution without any order as to costs. (Arindam Mukherjee, J.)
