By the said order, the writ petition was directed to appear under the heading Motion (Land) in the monthly list of June, 2025 refusing the appellants' prayer for upgradation and expeditious disposal.
Mr. Dhar, learned senior advocate appearing for the appellants submits that there was no intent on the part of the learned advocate for the appellants to mislead the Court. As the respondents were illegally encroaching upon the land pertaining to which a letter of intent was issued in favour of the appellant no.1 after it emerged to be the successful bidder in the tender process, the appellants' learned advocate prayed for treating the same to be a
matter under the categories mentioned in the list for early hearing.
He argues that no mala fide is attributable to the appellants and as the appellants are suffering extreme prejudice, the learned Single Judge may be requested for early disposal of the writ petition.
Mr. Karan, learned advocate and Mr. Saha, learned advocate enter appearance on behalf of the State respondents and the respondent no.6 respectively and deny the contention of the appellants.
We have heard the learned advocates appearing for the respective parties and considered the materials on record.
We do not find any infirmity in the order impugned since it has been rightly observed by the learned single Judge that the matter does not come under the categories as indicated in the list and, accordingly, the matter was directed to appear under the heading Motion (Land) in the monthly list of June, 2025. In view thereof, no interference is called for in the present appeal.
The appeal and the connected application are, accordingly, dismissed.
There shall, however, be no order as to costs. Urgent photostat certified copy of this order, if applied for, be given to the learned advocates for the parties.
