This writ petition has been filed assailing action of the respondent Bank under the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002. 2.

The writ petition is evidently not entertainable, firstly because the same is directed against action of a private Bank and secondly, because the petitioner has an equally efficacious and alternative remedy before the Debts Recovery Tribunal.

In such view of the matter this writ petition is not entertained.

WPA of therefore stands dismissed, however, leaving the petitioner free to take recourse to such other remedy that may be available to the petitioner strictly in accordance with law.
