Learned advocate for the appellant has submitted that the appellant does not intend to proceed with this instant appeal on the ground that the awarded sum has already been withdrawn by the claimants/respondents herein from the Trial Court by filing execution case. In support of her contention, she has filed one E-mail instruction of the appellant wherefrom it is seen that appellant wants to withdraw the appeal. The copy of E-mail instruction filed be kept with the record.

Thus, the appeal being FMA 4778 of 2016 stands dismissed for non-prosecution.

The sum deposited by the appellant/insurance company is permitted to be withdrawn by the appellant upon compliance of all requisite formalities.
