1. Learned counsel appearing for the petitioner submits as follows. The petitioner has been falsely implicated in this case. He was not present at the time of incident.

2. Learned counsel appearing for the State opposes the prayer for anticipatory bail. She relies on the statements of the victim and the independent eye-witnesses who have taken the name of the present petitioner as one of the assailants. While the co-accused namely, Krishna Mandal gave the blow with a Hasua, the present petitioner assaulted him with sticks, fists and kicks. The injury report shows a deep penetrating cut injury on the left side of the neck. As per the statements of the victim, 12 stitches were required to repair the injury. It was only after when the neighbours came that the assailants fled away.

3. Considering the above and the incriminating materials available in the case diary, I do not consider this to be a fit case to grant anticipatory bail to the petitioner.

4. Accordingly, the application for anticipatory bail is rejected.
