This special leave to appeal under Section 378(3) of the Code of Criminal Procedure has been filed assailing the order of dismissal dated 30th November, 2022 passed by the learned Judicial Magistrate, Bidhanagar, in connection with C Case No.477 of 2017. 2.

Having heard the learned advocate on behalf of the appellant on the ground of appeal and also having gone through the judgment impugned, I allow the instant application for special leave to appeal. 3.

The appellant is at liberty to prefer an appeal within the statutory period.
