Galib Ms. Priyamvada Singh ... for the State-respondent(s) The petitioners have approached this Court being aggrieved by the inaction of the police authorities particularly with regard to the fact that in spite of an ad interim injunction order passed in T.S. 87 of 2022, the same was violated by the private respondents qua interfering with the peaceful possession of the petitioners. The petitioners when resisted such acts and actions of the private respondents, the private respondents assaulted and inflicted injuries upon them. An information, to that effect, was furnished with the police authorities but the Inspector-in-charge of

Tapan Police Station did not take any step.

The petitioners have also drawn the attention of this Court to Tapan P.S.

Case No. 469 of 2021 dated 03.12.2021 under Sections 341/353/332/323/186/34 of the IPC.

I find from the records of the case that the said police case was registered on 03.12.2021 and last of the representations of the petitioners before the Inspector-in-charge of Tapan Police Station was on 18.11.2022.

Learned advocate for the petitioners also submits that till date the petitioners are unable to cultivate and harvest their crops.

Learned advocate for the State is present.

Having considered that more than two and half years have passed, in the meantime, from the date of last of the

representations submitted by the petitioners, if the situation still persists, the petitioners will file a fresh representation before the ASP/DSP/SDPO in charge of Tapan Police Station who would assess regarding the ground reality of the inconveniences caused and/or if there is any feeling of insecurity amongst the petitioners as also as to whether there has been any violation of the order passed by the learned civil court and if the concerned superior officer finds that any cognizable offence has been committed at the behest of the private respondents, he/she would take steps in accordance with law.

With the aforesaid observations, WPA 1817 of 2023 is disposed of.

Pending application(s), if any, is also disposed of.
