10-09-2021 ct. no.34 debajyoti CRR 119 of 2012 In re: An application under Sections 397 and 401 read with Section 482 of the Code of Criminal Procedure. - And - In the matter of: Aloke Srivastava & Anr.

... Petitioners.

Mr. Arijit Ganguly ... For the State.

The present revisional application was preferred challenging the proceedings arising out of Bally Police Station Case No.730 of 2011 dated 12-09-2011. Earlier, by order dated 27-08-2021, a report was called for from the Inspectorin-Charge, Bally Police Station regarding the progress and status of the present case.

The report so submitted by Mr. Arijit Ganguly, learned advocate for the State, be taken on record. It reflects from the said report that on conclusion of investigation, prima facie no charge could be framed and as such, final report was filed before the learned Court below. As such, I am of the view that the revisional application has become infructuous. Accordingly, CRR 119 of 2012 is dismissed. Pending application, if any, is consequently disposed of. Interim order, if any, stands vacated.

All parties shall act on the server copies of this order duly downloaded from the official website of this Court. ( Tirthankar Ghosh, J. )
