The writ petition, being WP 18692(W) of 2008 (WPA 18692 of 2008) was disposed of by an order 7th August, 2008, passed by Soumitra Pal J. Alleging violation of the said order dated 7th August, 2008, the instant contempt petition was filed. Rule was issued against Shyamal Kumar Banerjee and Sk. Rajab Ali, the contemnors no.1 and 1A on 15th January, 2009. It appears from the order dated 26th February, 2009 that Shyamal Kumar Banerjee and Sk. Rajab Ali were present in Court on that date. The contempt application was thereafter directed to go out of list by an order dated 5th August, 2009.

It is submitted on behalf of the applicant/petitioner that the contempt application has become infructuous due to passage of time with the change in circumstances. The petitioner is not

also inclined to proceed further with the contempt application.

Considering such submission, the contempt application is disposed of without any further order.

The Rule is discharged.
