The petitioner is seeking compassionate appointment on the ground that the petitioner's father died-in-harness on 30th August, 2010 while working as BSI at SD Hospital in Dakshin Dinajpur under the Directorate of Health Services. The petitioner's father, therefor, was admittedly an employee of Government of West Bengal. The petitioner's grievances are, therefor, required to be ventilated before the jurisdictional tribunal constituted under Administrative Tribunal Act, 1985 in view of the provisions laid down in Section 3(q) and Section 15 of the said Act.

The writ petition is, therefor, dismissed as withdrawn with liberty to the petitioner to file afresh

on the self-same cause of action before the jurisdictional tribunal, if so advised.
