Soujanaya Bandyopadhyay, learned advocate appears on behalf of the respondents/cross-objectors and submits that his clients also do not want to proceed with cross-objection filed in the said appeal.

In view of the aforesaid, S.A. 147 of 2012 and the C.O.T 28 of 2012 thereto are dismissed for non-prosecution.

No order as to costs.

The department is directed to send down the Lower Court Records to the concerned Court immediately.
