(Via Video Conference) The appellant is not represented nor any accommodation is prayed for on behalf of the appellant. The report shows that the postal envelope sent to the addresses of the appellant (sole) and the respondent No.4 mentioned in the memo of appeal were returned unserved with the endorsement "Not Known" and "Deceased" in respect of respondent No.2. Insofar as the respondent No.3 is concerned, it was returned with the endorsement "Addressee Left Without Address". The report of the Additional Stamp Reporter date 12th April, 1999 has pointed out various defects. No attempt was made to cure such defects by the parties in the meantime. This matter appeared for a number of time in the list. It clearly shows that the appellant is not interested to proceed with the second appeal.

The second appeal stands dismissed for noncompliance of our earlier orders.

The learned Registrar Administration (L&OM) is directed to communicate this order to the learned Civil Judge (Junior Division), Lalbagh, Murshidabad in

connection with Title Suit No.289 of 1998 for information and doing the needful.

The department is directed to communicate this order to learned Registrar Administration (L&OM).
