The discretion exercised by the learned Single Judge in refusing to pass any interim order does not call for any interference at this stage. 2.

Hence, the appeal and the application are dismissed.

However, there shall be no order as to costs. 4.

In the event the affidavits have not been filed in terms of the direction of the learned Single Judge, the writ petitioner may mention the writ petition for listing with a prayer for expeditious disposal of the writ petition and the writ petition may be heard as unopposed.

However, it would be open for the learned Single Judge to decide the matter on production of the relevant record.
