Petitioner applied for licence in respect of notification being no.209/CFS/2023 dated March 22 of 2023.

After such application, his proposed shop cum godown was inspected. But after some time his candidature was rejected without assigning any reason. The petitioner has approached the authority through two representations (at page 33 and 35 of the writ petition). None of the representations of the petitioner were considered. Hence, this writ petiton.

It appears that candidature of the petitioner was rejected by making necessary intimation in online portal. However portal has not disclosed the reason. According to the Control Order, the authority is not required to show the reasons for rejection.. However, I think it necessary to passed a direction upon the

authority to disposed of the representations of the petitioner (at page 33 and 35 of the writ petition) Under the above observations, the writ petition is disposed of with a direction to the concerned Subdivision Controller, Food and Supply, Contai, Purba Medinapore, being respondent no.4 to dispose of the representations of the petitioner appearing in page 33 and 35 of the writ petition within eight weeks from date, when the petitioner shall placed the copy of the representation again to the authority concerned. The authority shall give opportunity of being heard to the petitioner and shall intimate the decision to the petitioner within two weeks thereafter.

I make it clear that this court has not gone into the merits of this matter.

The concerned respondent no.4 is at leave to dispose of the representations according to law. Since no affidavits have been exchanged between the parties, the allegation made in the writ shall be deemed to have been not admitted.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
