1. This revisional application under section 529 of the Bharatia Nagarik Surakshya Sanhita has been filed by the petitioner for expeditious disposal of the instant proceeding in connection with Mahishadal Police Station Case No.453/2023 dated 24th July, 2023, under section 307/323/325/34/341/379 /384/427/448/506/354 of IPC pending before the Additional Chief Judicial Magistrate (II) at Haldia, Purba Medinipur. Charge-sheet has been submitted on 30th September, 2023.

2. It is however, submitted by the learned advocate appearing for the petitioners that charge has not yet been framed and the next date is fixed on 10th September, 2025. Accordingly, prayer has been made for passing necessary order.

3. Heard the submission and perused the case record.

4. It appears from the case record that the charge-sheet has been submitted and the case record has been transferred to the learned Additional District Judge, Haldia, Purba Medinipur for disposal.

However, it transpires that the accused

persons/present petitioners were absent in the court below on 28th October, 2024, due to miscommunication with their learned advocate.

5. It is also a fact that the court below is heavily burdened with number of cases. That apart, the learned trial court should also look into the plight of the litigants and to make all endeavour to proceed with the case as expeditiously as possible.

6. In the above facts and circumstances, the learned trial court is directed that this revisional application be disposed of as early as possible.

7. It is made clear that this revisional application is heard in absence of the opposite party without giving any direction to serve the application to the opposite party and if any allegation levelled against the present petitioners by the opposite party, the same is not to be treated as admitted.

8. With the aforesaid direction the revisional application is disposed of.

9. Urgent Photostat certified copy of this order, if applied for, be given to the parties, on priority basis, upon compliance of all necessary formalities.
