1. Report filed on behalf of the State is taken on record.

2. Learned counsel appearing for the petitioner submits that other than the statement of the co-accused, there are no incriminating materials available against the present petitioner.

3. Learned counsel appearing for the State submits that other than materials available in the case diary, the petitioner has eight criminal antecedents including five that involved offences under the NDPS Act.

4. Considering the above, the other incriminating materials available in the case diary and the restrictions contained in Section 37 of the NDPS Act, I do not consider this to be a fit case to grant anticipatory bail to the petitioner.

5. Accordingly, the application for anticipatory bail is rejected.
