Learned counsel for the petitioner seeks liberty to file an application for discharge before the learned trial court. 3.

Predominantly, the ground taken is that the petitioner who is an army officer was not even present on the day of incident at the alleged place.

The petition is dismissed as withdrawn with liberty to file a discharge application.

All the contentions are left open. It is made clear that the court has not gone into the merits of the case and no expression made herein shall tantamount to be an expression on the merits of the case.

Learned trial court shall decide the discharge application expeditiously in accordance with law.
