Chakraborti ... for the petitioners The petitioner has preferred the present revisional application challenging the continuation of the proceedings arising out of Sonarpur P.S. Case No. 510 dated 27.9.2007, which is presently pending before the ld. Addl. Sessions Judge, 8th Court, Alipore.

On perusal of the enclosures to the revisional application, I find that the charge sheet has only been enclosed but none of the documents under section 207 of the cr.p.c. has been enclosed along with the revisional application.

Having regard to the fact that charge have already been framed and the documents under sections 207 of the cr.p.c have not been enclosed as well as the ld. trial court has expressed its prima facie satisfaction regarding the materials available for framing of charges under section 409 of the cr.p.c. and fixed date in the year 2021 for evidence of CSW1, the revisional application, according to me, has been filed belatedly as such, no interference is made.

However, the petitioner would be at liberty to take up the issues at the appropriate stage of the trial. The ld. trial court would consider the same in accordance with law without being influenced by any of the observations made by this Court.

With the aforesaid observations, CRR 343 of 2024 is disposed of.

Pending application, if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
