None appears for the petitioner at the time of call, although the CESC Limited and the State are represented through counsel.

Learned counsel for the CESC Limited points out from Annexure P-4 at page 20 of the writ petition itself that a dispute as regards splitting of load has been raised by the CESC Limited.

It transpires from the prayers made in the present writ petition that the grievance of the petitioner is that no electricity connection is being given to the petitioner despite the petitioner having applied for the same. Annexure P-4 at page 20 of the writ petition, as rightly pointed out by learned counsel for the CESC Limited, clearly expresses the apprehension of the CESC Limited

regarding splitting of the existing load if such connection is given to the petitioner.

It is well-settled under the extant Regulations and Law that such disputes have to be resolved by the Grievance Redressal Officer (GRO).

Accordingly, WPA No. 1852 of 2023 is disposed of by granting liberty to the petitioner to approach the concerned GRO with the dispute as raised in this writ petition.

If so approached, the GRO shall decide the said dispute in accordance with law upon giving an opportunity of hearing to all concerned. There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
