Mr. Imran Ali Mrs. Debjani Sahu .....for the State This is an application challenging the issuance of warrant of arrest against the petitioners.
Let a copy of this application be served upon Mr. Imran Ali and Mrs. Debjani Sahu, learned counsels, who are present in court today and who ordinarily appear on behalf of the State. Their engagement may be regularised in due course by the competent authority of the State.
Learned counsel appearing on behalf of the petitioners submits as follows. The petitioners were granted anticipatory bail in 2014. Immediately thereafter, they surrendered before the learned trial court. The accused had been regularly attending court.
Due to some miscommunication on 21.12.2021 the petitioners failed to take steps before the learned trial court and warrant of arrest was issued. The petitioners want to join the proceeding at the earliest. Learned counsel on behalf of the State submits that the petitioners may be directed to surrender before the learned trial court at the earliest.
I have heard submissions of the learned counsels appearing on behalf of the petitioners and the State and have perused the revision petition.
It appears that the petitioners had been attending the Court for quite some time. For their inability to take steps on particular day, a warrant of arrest was issued. At present the petitioners want to join the proceeding at the earliest. In view of the above, let the warrant of arrest issued against the petitioners shall remain stayed for a period of four weeks from this date. The petitioners shall surrender before the learned trial court within the said period of four weeks from this date. In the event the petitioners surrender before the learned trial court within such time and pray for bail, then the application for bail shall be considered in accordance with law.
With these observations, the revisional application is disposed of Urgent photostat certified copy of this order may be supplied to the parties expeditiously, if applied for. (Jay Sengupta, J.)
