19-02-2025 (ct. no.29) debajyoti (rejected) CRM (DB) 359 of 2025 In re: An application for bail under Section 439 of the Code of Criminal Procedure/483 of the Bhartiya Nagarik Suraksha Sanhita in connection with Baishnabnagar Police Station Case No.228 of 2024 dated 21-03-2024 under Sections 489B/489C/120B/34 of the Indian Penal Code.

- A n d - In the matter of : Nayan Bibi .... Petitioner.

Mr. Arup Kumar Bhowmick ... For the Petitioner.

Mr. Atif Ahmed Siddiqui ... For the State.

Dictated by Arijit Banerjee, J.

1. The petitioner renews her prayer for bail which was rejected on merits twice, firstly on June 10, 2024 in CRM (DB) 1669 of 2024 and then on November 06, 2024 in CRM (DB) 3294 of 2024. She says that after the last rejection, two coaccused persons have been granted bail. She is in custody for 11 months. Even charge has not been framed.

2. Learned State advocate, while opposing the prayer, tells us that charge sheet was submitted on June 14, 2024. Copy was served under Section 207 of the Code of Criminal Procedure on December 20, 2024. April 09, 2025 has been fixed as the date for framing of charge. There are ten charge sheet named witnesses. The trial should conclude within a short span of time.

3. We find that the petitioner has suffered rejection on merits on two occasions. A separate case has been registered against the husband of the petitioner. It appears that the

petitioner and her husband are involved in dealing with fake currency. In view of the gravity of the offence and prima facie involvement of the petitioner therein, we are not inclined to allow the petitioner's prayer for bail, at this stage.

4. The application for bail is, thus, dismissed.

5. All parties shall act on the server copies of this order duly downloaded from the official website of this Court.

6. Criminal Section is directed to supply certified copies of this order to the parties, if applied for, upon compliance of all necessary formalities.
