Apprehending arrest in connection with Domkol P.S. Case No. 400 of 2020 dated 30.07.2020 under Sections 147/148/149/307/34 of the Indian Penal Code and Sections 3/4 of Explosive Substance Act, the present application has been preferred.

In view of the order passed by a co-ordinate Bench of this court on 2nd December, 2020 in CRM 9580 of 2020 granting bail to five accused persons similarly placed as that of the petitioner on the ground that no one was injured in the course of the incident and the nature of allegations and other attending circumstances which do not warrant immediate arrest of the petitioners therein, we allow this application for anticipatory bail of the petitioner.

We also record that the learned counsel for the State has submitted that the petitioner stands on the same footing as that of the five accused persons who were granted anticipatory bail by a co-ordinate Bench of this Court in CRM 9580 of 2020.

Accordingly, we allow the application for anticipatory bail and direct that in the event of arrest, the petitioner, namely, Jalil Sk shall be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten thousand only), with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.

The application for anticipatory bail, being CRM 829 of 2021 is, thus, disposed of.
