Heard learned Advocates for both the parties. 2.
We have considered the materials on record. Stolen mobile phones have been recovered. Complicity of petitioner transpired from statement of co-accused before police officer which is inadmissible in law. Keeping in mind the extent of complicity of the petitioners in the alleged crime, we are of the opinion their custodial interrogation is not necessary and they may be granted anticipatory bail. 3.
Accordingly, we direct in the event of arrest, the petitioners, namely, (1) Ahidul Seikh @ Ahidul Sekh @ Ahidul Sk. & (2) Bapi Sk. @ Saddam Hossain, be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten thousand only) each, with two sureties of like amount each, to the satisfaction of the arresting officer and also subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 and on further condition that the petitioners shall meet the Investigating Officer once in a week until Signed By : ARUP KUMAR DAS High Court of Calcutta 10 th of February 2025 01:37:53 PM
