Despite a second notice in the day, the State is not represented. The police are also not represented. The petitioners are the present and retired employees of the State Government. They wish to hold a peaceful demonstration from Subodh Mallick Square to Kolkata Municipal Corporation on 27.01.2023 from 12 p.m. to 4 p.m. They want to hold sit-in demonstration in front of the KMC headquarters and Aminia Restaurant area indefinitely.

The aforesaid indefinite demonstration cannot be permitted since the same would cause a complete chaos for traffic and movement of the public at large. In the above circumstances, as suggested by Mr. Banerjee, learned counsel for the petitioners, the petitioners may hold their rally and eventually converge at the Shahid Minar Premises. They may hold their peaceful demonstration at Sahid Minar Premises without causing any inconvenience to any other group or persons, who are holding other demonstration thereat.

Kolkata police shall deploy appropriate number of police personnel to hold the demonstration.

Counsel for the petitioners, Mr.

Banerjee specifically undertakes before this Court that the demonstration shall be peaceful and his clients would clean up the area at the end of the demonstration on each day.

With the aforesaid observations, the writ petition is disposed of.

There will be no order as to costs.
