This is an application for expeditious disposal of G.R. case No. 7536 of 2015 corresponding to Dum Dum Police Station Case No. 1196 of 2015 dated 21st November, 2015 under Sections 498A/323/ 325/307/384/506 /34 of the Indian Penal Code presently pending before the learned Additional Chief Judicial Magistrate, Barrackpore. 2.

On perusal of the averment made in the instant revision and having heard the learned Advocate for the petitioners this Court is of the view that the instant revision can be disposed of here and now with the assistance of the learned Advocate for the State. Accordingly, Mr. Gautam

Banerjee learned Advocate is requested to assist this Court on behalf of the state. Appointment of Mr. Gautam Banerjee learned advocate be regularized by the learned Legal Remembrancer, Government of West Bengal.

It is submitted by the learned advocate for the petitioners that the case was initiated on the basis of a written complaint made by one Payel Saha being the wife of petitioner no. 1 herein before the Dum Dum Police Station on 21st November, 2015 alleging, inter alia, that after their marriage on 30th January, 2015 she was subjected to mental and physical torture. Thereafter she found petitioner no. 1 having extra marital affair. On 13th December, 2015 she came to know that the petitioners are trying to kill her so she fled from her matrimonial home on 15th December, 2015 and lodged complaint on 17th December, 2015 before the police authorities. Application under Section 156(3) of the Cr.P.C. was instituted being M.P. case no.

1923 of 2015 before the Learned Additional Chief Judicial Magistrate, Barrackpore on 18th December, 2015 where the learned court below directed the Inspector in Charge to treat the same as FIR. The petitioners surrendered before the learned Court below and got regular bail. After completion of investigation, chargesheet was submitted dated 29th February, 2016. Thereafter charge was framed on 30th August, 2019 against the petitioners under section 498A/506/34 of the IPC fixing 4th September, 2019 for evidence of CsW1. Due to Covid-19 lockdown the petitioners failed to appear and the matter lastly appeared on 4th November, 2022 and the next date has been fixed on 21st July, 2023.

Under such circumstances, petitioners have prayed for expeditious disposal of the case.

In view of such circumstances, the instant revision is disposed of directing the trial court to conclude the trial as expeditiously as possible within December, 2023.
