Mr. Lal Mohan Basu, learned State advocate led by Mr. Amal Kumar Sen, learned Additional Government Pleader, appears for the Staterespondents. The petitioner being the son claims compassionate appointment. The deceased State employee was the father of the petitioner who expired on November 18, 2002 as died in harness as pleaded in paragraph-2 to the petition. The mother of the petitioner on February 18, 2003 applied seeking compassionate appointment for her. The employer asked for relevant documents and records and ultimately on March 26, 2018

and June 9, 2017, the prayer for compassionate appointment was rejected.

The law is well settled.

Compassionate appointment is a welfare policy of the State/employer.

Such an appointment cannot be claimed as a matter of right. The purpose and object of compassionate appointment is to meet the immediate crisis being faced by the family of the deceased employee due to the untimely death of the employee during employment. Compassionate appointment is not the mode of generation of employment or distribution of employment.

The record shows that the death of the employee occurred in 2002 and the family has still been surviving even then the instant writ petition has been filed in 2025.

The writ petition is totally devoid of any merit.

Accordingly, this writ petition, WPA 2200 of 2025 stands dismissed, without any as to costs. Photostat certified copy of this order, if applied for, be furnished expeditiously.
