The petitioner claims compassionate employment on account of the death of her mother-inlaw, Mamata Singha, who was a Sahayika in Debipur Muchipara Kantal Bagan Sishu Siksha Kendra.

Counsel for the petitioner submits that his client has made a representation in this regard to the District Magistrate, Malda.

Counsel for the State respondents submits that it has been clarified by the Panchayat and Rural Development Department in Memo No. 1338 dated 17th April, 2015 that there is no provision for died in harness appointment under the aforesaid category of employment.

In those circumstances, no order can be passed in favour of the petitioner.

Hence, the writ petition must fail and is dismissed.

There will be no order as to costs.
