Learned advocate appearing for the petitioner submits that the subject matter of the recovery in the present case are 97 bottles of phensedyl and 673 ampoules of buprenorphine. There has been no recovery from the present petitioner but the petitioner was shown arrested in connection with the instant case. Learned advocate for the State submits that there is an antecedent of the present petitioner.

I have taken into account that there were 150 bottles of phensedyl recovered in connection with another case wherein the petitioner was arrested and subsequently shown arrested in connection with the present case.

So far as the present case is concerned, only statements of witnesses are available. As such, the prayer for bail of the petitioner is allowed.

Accordingly, petitioner namely, Nayan Chouhan shall be released on bail upon furnishing bond of Rs. 20,000/- (Rupees Twenty Thousand only), with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Special Judge under NDPS Act cum learned Additional Sessions Judge, 3rd Court, Dakshin Dinajpur at Balurghat.

If on bail, the petitioner shall be physically present on each and every date before the learned trial Court in seisin of the case and shall not leave the jurisdiction of district of Dakshin Dinajpur without the prior permission of the learned Special Court. Thus, the application for bail being CRM (NDPS) No. 185 of 2026 is allowed.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
