The parties are not represented.

The appeal is against an order dated 20th December, 2023 passed by a Single Bench of this Court granting simple interest at the rate of 10% per annum on the total amount of gratuity to the respondent No.4 for delay in making payment of gratuity.

The Single Bench has rightly found that the delay in payment of gratuity and any other terminal benefits would automatically attract interest. Payment of gratuity is also required to be made within 30 days of retirement of an employee.

In these circumstances, the award of interest at the rate of 10% per annum on the amount of gratuity to the employee/respondent No.4, cannot be faulted.

The impugned order dated 20th December, 2023 calls for no interference whatsoever.

Hence, FMA of shall stand dismissed.

7.

Interim orders, if any, shall stand vacated.

8.

There shall be no order as to costs.

9.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
