This is an application for bail in connection with English Bazar Police Station Case No. 1184 of 2019 for committing offence punishable under Section 8(c) read with Section 22(c) of the Narcotic Drugs and Psychotropic Substances Act at the behest of the petitioner.

The commercial quantity of contraband has been allegedly seized from the possession of the petitioner and it appears that though charge-sheet has been submitted, but the charges have not been framed as yet.

We find from the record that the earlier application for bail filed by the petitioner got dismissed on 12th May 2020 in CRM 3417 of 2020. Since the commercial quantity of contraband was recovered from the possession of the petitioner, we do not find any ground has been made out for taking exception to Section 37 of the Narcotic Drugs and Psychotropic Substances Act.

However, we request the learned Special Judge, 3rd Court, under NDPS Act, Malda, to show utmost efforts to frame the charges and set the ball in motion so that it can reach to its logical end at the earliest.

The application for bail being CRM 835 of 2021 is disposed of.
