This is an application under Article 226 of the Constitution of India wherein the writ petitioner is aggrieved by the inaction on the part of the respondent-State authorities in considering her application for higher scale of pay.

Mr. Susanta Pal, counsel appearing on behalf of the State submits that certain documents had been sought for on July 14, 2020 by the District Inspector of Schools (S.E.), Paschim Bardhaman from the school authorities and these documents are still awaited.

Accordingly, I direct the school authority to supply these documents once again (it is contended in the petition that the documents have already been supplied) to the District Inspector of Schools (S.E.), Paschim Bardhaman within a period of two weeks. Upon receipt of such documents, District Inspector of Schools (S.E.), Paschim Bardhaman is directed to grant an opportunity of hearing to

the petitioner and thereafter pass a reasoned order in accordance with law within a period of four weeks from the date of receipt of the documents. The reasoned order should be communicated to the petitioner within a week from the date of passing of the same.

With these observations, this writ petition stands disposed of.

Since, no affidavit-in-opposition has been called for the allegations made in the writ petition are deemed to have not been admitted by the respondents.

There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
