The revisional application has been preferred challenging the order dated 23.09.2009 passed by the learned Chief Judicial Magistrate, 3rd Court, Howrah in Miscellaneous Case No. 88 of 2009 under Section 125 of the Code of Criminal Procedure. The maintenance awarded in the said case was to the tune of Rs.3000/-. The husband being aggrieved approached this court. Having regard to the fact that the revisional application was accompanied with an application under Section 5 of the Limitation Act and till date the said application has not been considered, there is no room for interference at this belated stage on the issues relating to the factual appreciation of the case.

Accordingly, the revisional application being CRR 117 of 2010 is dismissed.
