Niranjan Das (Via Video Conference) The appellant is not represented either physically or on virtual mode, nor any accommodation is prayed for. The matter was adjourned earlier on 3rd February, 2021 where we have categorically stated that in the event the appellant is not represented on the adjourned date, it shall be presumed that the appellant is not interested to proceed with the matter. Moreover, the appeal has been preferred along with an application for condonation of delay. In view of the fact that the appellant is not represented, we dismiss the application for condonation of delay for default and, accordingly, the appeal and the application for appropriate order also stand dismissed.
