Apprehending arrest in connection with Santipur P.S. Case No. 228 of 2020 dated 22.05.2020 under Sections 498A/304B/34 of the Indian Penal Code, the present application has been preferred.
The petitioner happens to be the mother-in-law of the deceased. The learned advocate for the State submits that within two years of marriage, the victim committed suicide because of the torture inflicted by the in-laws. According to the learned advocate, there are materials that prior to the unfortunate incident, there was abetment at the instance of all the family members including the present petitioner. We have been informed that the investigation of the case has already been concluded and charge-sheet has
already been filed and some of the accused have already been released on bail.
Having regard to the stage of the case, we are of the opinion that custodial detention of the present petitioner is not warranted.
Accordingly, we allow the application for anticipatory bail and direct that in the event of arrest, the petitioner, namely, Dipa Rani Dutta shall be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten thousand only), with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
The application for anticipatory bail, being CRM 836 of 2021 is, thus, disposed of.
