Learned Advocate appearing for the petitioner submits that the petitioner is in custody for 426 days. He submits that the police deliberately shown a seizure of 22 kg 700 grams in the seizure list when the commercial quantity commences from 20 kgs.

State is represented.

We have considered the case diary produced in Court. The issue as to whether a commercial quantity was seized from the petitioner or not is best decided at the trial. The petitioner is unable to establish conclusively that commercial quantity was not recovered.

We are unable to grant bail to the petitioner as prayed for.

C.R.M. 838 of 2021 is dismissed.
