The petitioner complains of inaction by the Shibpur Police Station in connection with first information report no.406 of 2022 dated 7.12.2022 under Sections 420/406 IPC.

The petitioner's grievance is that the private respondent obtained Rs.15 Lacs on the promise of getting a job for the petitioner's brother. The petitioner was a married man and was also living in with the private respondent.

Counsel for the State submits that the petitioner himself is facing trial in connection with charge sheet no.707 dated 18.10.2020 under Sections 417/376/ 420/506/34 IPC. The State submits that the subject first information report is most likely a counter blast to the complaint, which is being tested in trial against him.

Be that as it may, since the first information report no.406 of 2022 has been registered under the directions of the concerned Magistrate, let investigation be completed therein within a period of 45 days from date mandatorily and positively. WPA No.1880 of 2023 stands, accordingly, disposed of.
