1. Copies of judgments acquitting the petitioners from three criminal cases as filed in Court are taken on record.
2. Report filed on behalf of the State is taken on record.
3. Learned counsel appearing for the petitioners submits that other than the statement of the co-accused, there is no incriminating material available against the petitioners. The petitioners have been acquitted in three cases where he was charged.
4. Learned counsel appearing for the State opposes the prayer for anticipatory bail. He relies on the report and the case diary and submits that apart from the statement of the co-accused, the petitioners have three criminal antecedents.
5. However, it appears from the copies of the judgments that the petitioners have been acquitted in three cases which are there in the report of the State.
6. In view of the above, the petitioners have been able to rebut the restrictions contained in Section 37 of the NDPS Act and considering the other materials available in the case diary, I am inclined to grant anticipatory bail to the petitioners.
7. In the event of arrest, the petitioners shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to further conditions that the petitioners shall cooperate with the investigation and shall not threaten or intimidate the witnesses. The petitioners shall surrender before the learned jurisdictional Court and pray for bail within four weeks from date and regularly attend the jurisdictional Court.
8. Accordingly, the application for anticipatory bail is allowed.
9. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
