Report submitted by Ms. Sujata Das, learned advocate appearing for the State be kept with the record. Report reflects that on 30th January, 2023, learned CJM, Howrah was pleased to forfeit the bail bonds and thereafter fix 27.12.2023 as date for execution return of the warrant of arrest. Having considered the delay which has occasioned in the case and purposely designed by the accused persons in delaying the progress of the proceedings, I direct that the learned CJM, Howrah would prepone the date of 27.12.2023 and take steps towards issuance of proclamation and the subsequent attachment in respect of the accused persons who are ignoring the process of the court. Let such steps be taken preferably by 30th September, 2023.

Learned CJM, Howrah, if required, would take assistance

of the Commissioner of Police, Howrah for compelling the appearance of the accused persons with the aid of harsher process of law.

At this stage, no comments are made regarding the future course of trial.

Petitioner is granted liberty to approach this Court once the accused persons are brought before the court. With the aforesaid observations, CRR 256 of 2023 is disposed of.

Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
