The petitioner prays for certain directions for payment to be passed upon the Birbhum National Institute of Higher Education and D.El.Ed College. The petitioner admits that the college is a private institution.

The learned advocate representing the NCTE submits that the Council does not have any financial or administrative control over the institute in question. Accordingly, the prayer of the petitioner for directing payment upon a private institution cannot be entertained by the Court.

The writ petition fails and is hereby dismissed.

Dismissal of the writ petition, however, will not stand in the way of the petitioner from approaching the appropriate forum for necessary relief, if so advised. Urgent photostat certified copy of this order, if applied for, be given to the parties after completion of all legal formalities.
