Let the affidavit of service filed by the petitioner be kept with the record.

The petitioner alleges that his brother, who owns a plot of land adjacent to the petitioner's residential building, has deviated from the sanctioned plan granted by the concerned Panchayat while constructing his residential house. The petitioner further alleges that, despite his objections, respondent no. 5 (his brother) proceeded with the construction work, which has resulted in complete obstruction of light and air to the petitioner's building.

Respondent no. 5 is not represented.

It appears that the petitioner has already made a representation before the Block Development Officer, Ranaghat-I, Habibpur, District - Nadia, alleging unauthorized construction by respondent no. 5. A copy of the said representation was also

forwarded to the Pradhan, Payradanga Gram Panchayat, Pritinagar, District - Nadia.

I do not find any justification to keep this writ petition pending. Accordingly, the writ petition is disposed of with a direction upon the Payradanga Gram Panchayat to consider the representation of the writ petitioner appearing at page 62 of the writ petition, in accordance with law, after giving an opportunity of hearing to both the petitioner and respondent no. 5.

Upon hearing the parties, the Panchayat shall pass a reasoned order and communicate the same to the petitioner.

The entire exercise shall be completed within a period of eight weeks from the date of this order. Accordingly, WPA 2020 of 2025 stands disposed of.

Urgent Photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all formalities.
